This volume represents the proceedings of an international conference organized by the Tilburg Institute for Law Technology and Society TILT in Tilburg the Netherlands The book brings together a wide range of international scholars from a variety of disciplines to shed light on the multiple dimensions of technology regulation It presents different perspectives in an innovative way visualizing the emerging discipline of technology regulation as a multidimensional space The book explores a range of issues in the fields of nano materials and nano medicine biotechnology chemicals and ICT as well as overarching topics such as innovation regimes risk governance and responsive regulation By grouping the analyses along four dimensions type of technology type of regulation innovation and time it allows both scholars and practitioners to explore the space of technology regulation along new lines and to identify new possibilities for regulatory action and future research Technological developments pose enormous challenges for regulators Not only do regulators need to find an optimal balance between protecting fundamental values and public goods and the stimulation of creativity and innovation but they need to do so in a way that keeps pace with the speed and pervasive nature of technological developments Technology regulation is thus emerging as an important field of interdisciplinary research The book charts the multifarious challenges of new technologies and possible regulatory responses from a multidisciplinary perspective, Legal problems abound in the information society Electronic commerce copyright privacy illegal and harmful content taxes wiretapping governments face an enormous challenge to meet the advent of the Internet and ICT with a flexible up to date and adequate legal framework Yet one aspect makes this challenge even more daunting internationalisation br br br br Law is still to a great extent based on nation states but the information society is above all a borderless and global society Territoriality and national sovereignty clash with the need for a global approach to address ICT law issues Should states leave everything to the global market or should they intervene to protect vital national interests How can one enforce national rules in a world where acts take place somewhere in Cyberspace br br br br This book presents the positions on these issues of the governments of the Netherlands Germany France the UK and the US as well as of international organisations How do they think about co regulation law enforcement harmonisation international cooperation and alternative dispute resolution How do they deal with applicable law and online contracts privacy international liability of Internet providers and electronic signatures What are the implications of the European Electronic Commerce Directive and the draft Crime in Cyberspace convention br br br br Any legal framework that is to fit the global information society must take into account internationalisation This volume shows to what extent governments are meeting this challenge, Combating cybercrime requires law enforcement expertise manpower legislation and policy priorities within the ambit of crime fighting Because of the utterly transnational character of cybercrime countries must focus on international investigation and prosecution As cultural and legal traditions play a major part in countries views on the exercise of criminal law and sovereignty a unified approach to this phenomenon requires serious reflection This book intends to contribute to a more concerted international effort towards effectively fighting cybercrime by offering an in depth survey of views and practices in various jurisdictions It includes chapters on the Council of Europe s Cybercrime Convention and on international co operation in criminal matters Thirteen country reports written by experts in the field are included in alphabetical order The book concludes by discussing one of the most urgent steps that needs to be taken resolving positive jurisdictional conflicts when several jurisdictions seek to prosecute a cybercriminal at the same time, No description available
